Order entered June 23, 2025, by Magistrate Judge Virginia K. DeMarchi denying without prejudice plaintiff Christopher J. Cordova’s ex parte application for a preservation order. Cordova argued that defendant Jonathan Huneault, operator of the Frauditor Troll channel, had deleted over 1,700 videos since the lawsuit was filed, creating a risk of spoliation. The Court held that Huneault already has a duty to preserve relevant evidence, that the takedown of videos followed Cordova’s own DMCA notice, and that Cordova had not shown a significant risk of destruction of other evidence or harm warranting an additional order.
